By downloading, installing, or using the SuperYou mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

SuperYou is a nutrition tracking and meal planning application that provides:

  • Personalized nutrition recommendations
  • Meal logging and tracking
  • Nutrient analysis and deficiency identification
  • Nutritional impact estimation for health-conscious users
  • Premium subscription features

3. Medical Disclaimer

SuperYou is NOT a medical device and is for informational purposes only.

  • The App does not provide medical advice, diagnosis, or treatment
  • Nutritional estimates are approximations based on general models and should not replace professional guidance
  • Nutrient deficiency warnings are educational, not diagnostic
  • Always consult a qualified healthcare professional before making dietary changes, especially if you have specific dietary needs or health concerns
  • Never disregard professional medical advice or delay seeking treatment because of information in this App

By using this App, you acknowledge that:

  • You are solely responsible for your health decisions
  • The App creators are not liable for any health outcomes

No Doctor-Patient Relationship

Use of this App does not create a doctor-patient or healthcare provider relationship. The App provides educational information only and should not be considered as professional medical consultation.

4. User Accounts and Data

4.1 No Account Required

  • The App does not require account creation
  • All data is stored locally on your device
  • You are responsible for backing up your data

4.2 Data Security

  • You are responsible for maintaining the security of your device
  • We are not liable for data loss due to device loss, damage, or unauthorized access
  • You acknowledge that data loss may occur and we are not responsible for restoring lost data

User Data Accuracy

We are not responsible for inaccuracies in recommendations or insights resulting from incorrect, incomplete, or outdated information provided by you. Accurate results depend on accurate input data.

5. Premium Subscriptions

5.1 Subscription Terms

  • Premium subscriptions are available as monthly or yearly plans
  • Payment is processed through Apple App Store via your Apple ID
  • Prices are displayed in the App before purchase

5.2 Billing

  • Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
  • Apple will charge your account upon confirmation of purchase
  • Account will be charged for renewal within 24 hours prior to the end of the current period

5.3 Cancellation

  • You can cancel your subscription at any time in Settings > [Your Name] > Subscriptions
  • Cancel at least 24 hours before the end of the billing period to avoid being charged
  • After cancellation, premium features remain available until the end of the current billing period

5.4 Refunds

  • All billing and refunds are handled exclusively by Apple
  • We have no control over and assume no responsibility for Apple's billing policies
  • Contact Apple Support for all refund requests

6. Acceptable Use

You agree NOT to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Use the App for any harmful, abusive, or unlawful activities
  • Provide false or misleading health information
  • Share your premium access with others
  • Interfere with the App's functionality

7. Intellectual Property

  • All content in the App, including text, graphics, logos, and software, is owned by SuperYou or its licensors
  • The App is protected by copyright, trademark, and other laws
  • You may not copy, modify, or distribute App content without written permission

8. Third-Party Services

The App uses third-party services:

  • Apple App Store: For payment processing and subscriptions
  • Firebase Analytics: For anonymous usage statistics
  • ObjectBox: For local data storage

Each third-party service operates under its own terms of service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "AS IS" without warranties of any kind
  • We do not guarantee the accuracy of nutrition information or health estimates
  • We are not liable for any health outcomes, dietary decisions, or medical conditions
  • We are not liable for data loss, device damage, or any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the App (if any) in the past 12 months

No Guaranteed Results

We do not guarantee any specific health, weight loss, or nutritional outcomes. Results vary based on individual factors, adherence to recommendations, and other variables beyond our control.

9.1 AI & Algorithm Disclaimer

All recommendations, nutritional insights, and health estimations provided by SuperYou are generated using automated algorithms. These include:

  • Nutrient deficiency calculations
  • Carbohydrate and glycemic impact estimates
  • Meal suggestions and recommendations
  • Daily nutrient requirement calculations

Important: These recommendations are NOT reviewed by medical professionals, nutritionists, or healthcare providers. They are based on general algorithms and may not account for individual dietary preferences, restrictions, or specific needs. Always verify recommendations with a qualified healthcare professional.

9.2 Food Database Accuracy

Nutritional values and food data displayed in the App are estimates based on publicly available databases and may not be 100% accurate. Factors affecting accuracy include:

  • Natural variations in food composition
  • Differences in preparation methods
  • Brand and regional variations
  • Database update delays

Users should not rely solely on this App for critical nutritional decisions.

10. Indemnification

You agree to indemnify and hold harmless SuperYou, its creators, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Modifications to Terms

We may modify these Terms at any time. Changes will be effective upon posting to https://superyou.life/terms. Your continued use of the App after changes constitutes acceptance.

12. Termination

We may terminate or suspend your access to the App at any time, without notice, for:

  • Violation of these Terms
  • Any other reason at our sole discretion

Upon termination:

  • Your right to use the App ceases immediately
  • Premium subscription fees are non-refundable
  • Sections that should survive termination will remain in effect

We reserve the right to remove or restrict access without liability at any time.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Gandhinagar, Gujarat, India.

For users accessing the App from other jurisdictions, you agree that these Terms and any dispute arising hereunder shall be governed by the laws of India, and you consent to the jurisdiction of courts in Gandhinagar, Gujarat, India.

14. Dispute Resolution

Any disputes arising from these Terms or use of the App shall be resolved through:

  1. Good faith negotiation between the parties
  2. If unresolved, binding arbitration in accordance with the Arbitration and Conciliation Act, 1996
  3. The seat of arbitration shall be Gandhinagar, Gujarat, India
  4. Each party bears its own costs

15. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, server outages, government actions, pandemics, or other unforeseen circumstances.

16. Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations while using the App.

17. Experimental Features

Some features of the App may be experimental or in beta testing. Such features are provided without guarantees and may be modified or discontinued at any time without notice.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
